Terms of Service

Important Purchase Terms

  • The entire sponsorship price is charged upfront in US dollars.
  • The physical logo is made and installed only after pool construction is complete.
  • The 365-day physical display term starts on the installation date.
  • Construction is funding-dependent and has no guaranteed completion date.
  • A funding pause or stall, including during a milestone, does not by itself create a refund, credit, completion payment, damages, or any other amount owed.

1. Agreement and Authority

These Terms govern purchases from The Ad Pool, operated by Riz Nwosu (“The Ad Pool,” “we,” “us,” or “our”). By checking the Terms box and continuing to Stripe Checkout, submitting payment, or providing brand assets, you agree to the version shown at checkout and confirm that you are authorized to act for the sponsoring company. If you do not agree, do not pay.

2. What You Are Buying

You are buying a sponsorship package tied to the pool position or positions listed in your checkout summary and receipt. The project is a real 33 × 15 ft residential swimming pool with sellable pool-base, Baja shelf, spa, modular perimeter, and corner positions.

You are not buying real property, ownership of the pool, equity, a security, a guaranteed number of impressions, guaranteed social reach, Google Maps or satellite placement, press coverage, sales, return on investment, or exclusivity unless a signed written addendum says so.

3. Full Upfront Payment

The full amount shown at checkout is due and charged immediately through Stripe. Payments are in US dollars. Your card statement may identify the charge with “AD POOL.” A spot is not sold until Stripe confirms payment and our system confirms that the position is still assigned to your order.

Prices may change for unsold positions. A confirmed purchase price will not increase after payment. Taxes, if legally required and shown at checkout, are additional.

4. Funding, Budget, and Construction Risk

At the prices published on August 30, 2026, all available sponsorship inventory totals $275,000. The current estimated project roadmap totals $176,668. Those figures are different because sponsorship revenue is not allocated dollar-for-dollar to construction milestones. Revenue may also pay for content production, card processing and administration, sponsor artwork fabrication and installation, contingencies, price changes, unexpected site conditions, and a budget buffer.

The public sponsorship counter reports gross sponsorship funding. The milestone roadmap reports only the portion allocated to construction, so the two displays need not move at the same rate.

Construction proceeds as sufficient funds and practical conditions allow. Funding may slow, pause, or stall before or during any milestone, and estimates, sequencing, contractors, scope, materials, and milestone amounts may change. There is no promised construction start date, completion date, or installation date.

A funding pause or stall is not the same as permanent cancellation. If funding stalls during a milestone, neither a refund, credit, completion payment, damages, nor any other amount is owed solely because of that stall or delay.

5. Physical Logo Delivery and Display Term

Physical fabrication and installation are conditional on completion of pool construction. No physical-logo deliverable is due before construction is complete. When your logo is physically installed, its display term begins and runs for 365 consecutive days. We will record the installation and term dates in the project records.

After the term ends, we may remove, cover, replace, renew, or resell the position. Normal wear, temporary maintenance, repairs, safety needs, weather, and events outside our reasonable control may interrupt visibility and do not extend the term unless we agree in writing.

6. Included Sponsor Deliverables

  • Physical placement: the purchased position for 365 days after installation, subject to these Terms.
  • Digital listing: a sponsor name/logo listing and direct website link added within 30 days after both full payment and usable artwork approval, and maintained through the physical display term while the project site is operated.
  • Sponsor spotlight: one sponsor-focused video distributed within 90 days after physical installation across the project's then-active TikTok, Instagram, YouTube, and X accounts. The same creative may be cross-posted, and platform removal outside our control is not a breach.
  • Content license: a non-exclusive, worldwide, royalty-free right to repost final project media that we directly supply to you and that features your placement, including on your website, organic social channels, and paid advertisements. On request, we will provide available final media within 30 days after it is first published.
  • Founding Sponsor recognition: identification as an original paid sponsor while the project site and its sponsor archive are maintained.

Appearance in construction updates is possible but not guaranteed. We control editorial format, creative treatment, production schedule, captions, and publication timing. Category exclusivity is not included unless separately confirmed in a written agreement signed before payment.

7. Logo Files, Approval, and License

You must provide usable logo artwork and respond to reasonable proof or file requests. Physical pool logos are produced in grayscale; color files may be used for digital display. You grant us a non-exclusive, royalty-free license to reproduce, adapt for fit, display, photograph, film, and distribute your submitted brand assets only in connection with the project and its promotion.

You represent that you own or are authorized to use the assets. We may reject content that is unlawful, infringing, deceptive, hateful, explicit, unsafe, or materially harmful to the project. We will request a compliant replacement. If we reject otherwise lawful assets and the parties cannot agree on a compliant alternative within 30 days, we may cancel that sponsorship and issue a full refund.

8. Position and Production Adjustments

The interactive map is a planning representation, not a construction drawing. We may make minor fit, scale, orientation, material, or alignment adjustments required by final construction or fabrication. The purchased position type and substantially comparable display area will remain the same. We will seek written approval before a material downgrade or relocation.

9. Refund and Cancellation Policy

Except where required by law, payments are non-refundable after confirmation because the selected inventory is removed from sale and funds may be deployed as they are received. A delay, funding gap, pause, or mid-milestone stall is not a cancellation and does not create a refund right.

A full refund is available only when:

  • we formally and permanently cancel the entire project before your logo is physically displayed;
  • we cannot provide the purchased inventory because of our own assignment error;
  • we reject an otherwise lawful logo and no compliant alternative is agreed under Section 7;
  • the charge is a verified duplicate or billing error; or
  • applicable law requires a refund.

Approved refunds are returned to the original payment method, normally initiated within 30 days. If your logo has already been installed, a refund is not available except where required by law. Email hello@theadpool.com with your order reference before filing a payment dispute so we can review the record promptly.

10. Performance and Third-Party Platforms

Audience counts are approximate snapshots and may rise or fall. We do not promise views, impressions, engagement, conversions, publicity, satellite imagery updates, Google Maps visibility, platform availability, or any business outcome. Third-party platforms may alter, restrict, remove, or stop distributing content outside our control.

11. Private Property and Safety

Sponsorship does not grant access to the residence, backyard, pool, production set, residents, guests, or private events. Any visit, shoot, or on-site participation requires separate written permission and compliance with safety and privacy directions.

12. Disclaimer and Liability

Except for the express obligations in these Terms, the project and site are provided “as is.” To the maximum extent allowed by law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages. Our total aggregate liability arising from a sponsorship will not exceed the amount actually paid for that sponsorship. Nothing here excludes liability that cannot legally be limited.

13. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Subject to any non-waivable consumer rights, disputes will be resolved in the state or federal courts serving Travis County, Texas.

14. Changes and Purchase Records

We may update these Terms for future purchases. A completed purchase remains governed by the Terms version accepted at checkout unless both parties agree otherwise in writing. We retain a purchase snapshot and acceptance record for that purpose. If any provision is unenforceable, the remaining provisions continue in effect.
